29 CFR 1926.20(b)(2):     The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a) 1982 Route 70, Cherry Hill, NJ:  The employer, B C Stucco & Stone had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  As such, workers onsite were observed working from the top of the welded tubular frame scaffolding with no means of fall protection (PFAS, positioning system, safety nets, guardrails, etc.) and no appropriate means of access to the walking working surface.  Workers were exposed to a fall hazard in excess of 25 feet.  Observed on or about 05/10/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.      a) 1982 Route 70, Cherry Hill, NJ:  Employees onsite were observed on a welded tubular frame scaffold installing the wire mesh for the preliminary layer of the buildings stucco finish.  No appropriate means of access was provided to the walking working surface.  An employee was observed to be climbing the scaffolds frame.  The scaffold frame included rungs of varying length and spacing and was not designed to be utilized for access.  Observed on or about 05/10/2012.    NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19. Employees were exposed to a fall hazard in excess of 25 feet.  Observed on or about 05/10/2012. 29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) 1982 Route 70, Cherry Hill, NJ:   B C Stucco & Stone employees were observed working from the top of the welded tubular frame scaffolding with no means of fall protection (PFAS, positioning system, safety nets, guardrails, etc.) and no appropriate means of access to the walking working surface.  Employees were exposed to a fall hazard in excess of 25 feet.  The employer did not ensure that each employee was  trained to recognize the hazards and to understand the procedures to control or minimize those hazards.  Observed on or about 05/10/2012.
