29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM was begun; the employers did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: (a) The employer failed to have PACM (Presumed Asbestos Containing Materials) tested to disprove the presence of asbestos before starting interior demolition activities during the rehabilitation of a vacant 3 story pre 1970 apartment building. Employees demolished by hand plaster walls and their fire brick interiors. The PACM and other suspect building materials were not sampled to determine the presence (or absence) of asbestos.
