29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: (a) In the food court area on or about May 22, 2012, and at times prior thereto, there was no assured equipment grounding conductor program or ground-fault circuit-interrupter protection when extension cords were used to power 110 VAC Makita right angle grinders, Bosch circular saws, and DeWalt cut off saws. Employees used the portable power tools to fabricate and install decorative square tube work on the walls.
