OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    (a) Bellagio Stone, Inc. at 1449 S. Cherokee St. in Denver, CO: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. On and before May 22, 2012 employees were exposed to struck-by hazards where the compressed air was piped to the dry fabrication booth at 120 p.s.i. through PVC pipes.     Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to only use material with shatter resistance properties.  According to the American Society of Mechanical Engineers (ASME) B31.8-1986, the operating pressure of plastic piping distribution systems must be limited to 100 p.s.i. and must be protected from external damage and deterioration. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment:    (a) Bellagio Stone, Inc. at 1449 S. Cherokee St. in Denver, CO: On and before June 27, 2012 sufficient access and working space was not provided and maintained about all electric equipment in that the main electrical disconnect to the building, three additional electrical disconnects, and a small electrical panel were located on the NW interior wall behind storage racks with no clear aisle or access. This condition exposed employees to an electrical hazard.    Abatement Note: The space required should be at least 30 inches wide and 3 feet deep from the face of the panel.

Cherokee St. in Denver, CO: The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment in that fabrication and stone handling tasks involving physical and chemical hazards were not assessed to determine PPE requirements.  Lack of a PPE Hazard assessment may prevent employees from choosing and using the correct PPE for a task.    Abatement Note: If such hazards are present, or likely to be present, the employer shall:  Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  Communicate selection decisions to each affected employee; and,  Select PPE that properly fits each affected employee. Note: Non-mandatory Appendix B contains an example of procedures that would comply with the requirement for a hazard assessment.
