29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a)  On or about May 23, 2012, one employee who was required to wear a Moldex 8940 respirator with P100 cartriges, while cleaning the mixer in the block plant with an air chisel, was exposed to respirable dust at an eight hour time weighted average of 2.03 mg/m3 for the 137 minute sampling period with a value of zero added for the minutes not sampled to equal 480 minutes.    (b)  That employee was wearing a beard which interfered with the face to facepiece seal of the respirator.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.242(b):  Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:    (a)  On or about May 23, 2012 employees were observed blowing concrete block dust which contained 6% silica off of their clothing with an air hose.    (b)  Employees used compressed air at 80 psi to clean equipment and PPE, such as respirators, on a daily basis.  The pressure was adjustable at the gauge on the air line, but no safety nozzle was used to reduce the pressure at the dead end of the air hose.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
