29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angel steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):      a) Jobsite, 225 - 227 Leverington Ave, Philadelphia - Two employees were installing footings, in a 6' deep excavation, which was approximately 4' to 10' wide, and approximately 25' long.  A concrete layer, near the top of the excavation, was undermined, on one side of the excavation.  The side wall was negatively sloped, with an angle greater than 180 degrees.  Soil samples contained > 85% sand and gravel, and were classified as Type C.  The employees were not protected from cave-ins, exposing the employees to multiple serious injuries and death.  Observed on or about 5/23/12.      NOTE:  No abatement certification or documentation required.

29 CFR 1926.651(j)(2):   Employees were not protected from excavated and other materials and equipment that could pose a hazard by falling or rolling into excavations:    a) Jobsite, 225 - 227 Leverington Ave, Philadelphia - Two employees were installing footings, in a 6' deep excavation, which was approximately 4' to 10' wide, and approximately 25' long.  On one side, a concrete layer, at the top of the excavation, was undermined.  Soil samples contained > 85% sand and gravel, and were classified as Type C.        The excavated material, which contained rock, stone, concrete, soil, and construction debris, was placed next to the excavation, on top of the undermined side wall and back wall of the excavation.  Employees were not protected from the excavated material or other materials falling or rolling into the excavation, exposing employees to serious injury and death.   Observed on or about 5/23/12.      NOTE:  No abatement certification or documentation required.

29 CFR 1926.651(i)(3):  Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    a) Jobsite, 225 - 227 Leverington Ave, Philadelphia - Two employees were installing footings, in a 6' deep excavation, which was approximately 4' to 10' wide, and approximately 25' long.  Soil samples contained > 85% sand and gravel, and were classified as Type C.  A layer of concrete, below the soil, at the top of the excavation, was undermined, along one side of the excavation.  The employer did not provide a support system or another method to protect employees from possible collapse, exposing employees to serious injuries and death.    Observed on or about 5/23/12.      NOTE:  No abatement certification or documentation required.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:      a) Jobsite, 225 - 227 Leverington Ave, Philadelphia - Two employees were installing footings, in a 6' deep excavation, which was approximately 4' to 10' wide, and approximately 25' long.  One one side, a concrete layer, near the top of the excavation, was undermined.  The side wall was negatively sloped, with an angle greater than 180 degrees.  Soil samples contained > 85% sand and gravel, and were classified as Type C.  Excavated concrete and soil were next to the excavation.   The employer did not ensure that the excavation, was inspected daily, by a competent person, exposing the employees to multiple serious injuries and death.  Observed on or about 5/23/12.      Note:  No abatement or certification documentation required.

29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or:     a) Jobsite, 225 - 227 Leverington Ave, Philadelphia - Two employees were installing footings, in a 6' deep excavation, which was approximately 4' to 10' wide, and approximately 25' long.  On one side, a concrete layer, near the top of the excavation, was undermined.  The side wall was negatively sloped, with an angle greater than 180 degrees.  Soil samples contained > 85% sand and gravel, and were classified as Type C.  Excavated concrete and soil were next to the excavation.   Employees were not protected from cave-ins by an adequate protective system.  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) in the excavation, that could have resulted in possible cave-insand did not instruct employees in the applicable regulations, exposing the employees to death, or serious injury and illness.  Observed on or about 5/23/12.        NOTE:  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
