29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: Second Floor: An employee was cutting material using a Hitachi Saw, s/n V071218. The saw was plugged into a metal electrical box that was lying on the floor and was not mounted. The employer used a flexible extension cord and wired it into the metal electrical box, as observed on or about 05/17/2012. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.134(k)(6): This provision is applicable to construction employment in accordance with 29 CFR 1926.103. The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (a) Commercial & Residential Renovation: The employees use a 3M, Model 8210, dust mask while painting, which contains Titanium Dioxide. The employees were not made aware of the basic advisory information in Appendix D of 29 CFR 1910.134, as determined on or about 05/17/2012. ABATEMENT CERTIFICATION REQUIRED
