On or about May 24, 2012, the spoil pile of the 5.5 feet deep trench was not set back from the edge of the trench, exposing employee to a cave-in hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE NOT REQUIRED

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: a. On or about May 24, 2012, the 5.5 feet deep trench did not have an adequate protective system, exposing employees to a cave-in hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE NOT REQUIRED
