29 CFR 1910.107(e)(1): The storage of flammable or combustible liquids in connection with spraying operations shall conform to the requirements of 1910.106, where applicable.    Workplace: Combustible and Flammable paints, thinners and other chemicals used in the automotive spray painting process were stored on the floor and on work tables. Theses chemicals include but were not limited to:  3M Bondo body filler, Klean Strip Gun cleaner and Bulldog Adhesive Promotor, Trans Star 2K Acrylic Urethane primer and Urethane Reducer Medium, Naked Gun Gold Gun Cleaner, Motor City  Clear Coat 8041, Nason Ful-thane catalyst, 483-15 Ful-Thane Catalyst and 2K 400-1 urethane, TCI DT-5 Virgin Lacquer Thinner,  HB Body 740 Acryl and 722 Hardener, USC 1240-1 Wax, Grease & Silicone Remover, Catalizador E-224 Acrylic Hardener, Mipa 2K Acrylic Clearcoat.

29 CFR 1910.107(b)(5)(i): The spraying operations except electrostatic spraying operations shall be so designed, installed and maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute. Electrostatic spraying operations may be conducted with an air velocity over the open face of the booth of not less than 60 linear feet per minute, or more, depending on the volume of the finishing material being applied and its flammability and explosion characteristics. Visible gauges or audible alarm or pressure activated devices shall be installed to indicate or insure that the required air velocity is maintained. Filter rolls shall be inspected to insure proper replacement of filter media.    SPRAYBOOTH: The air velocity across the filter on either side of the spray booth while the employee was engaged in spray painting operations was between 69 and 81 feet per minute on the left side and between 73 and 88 feet per minute on the right side of the spray booth.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:    WORKPLACE: The Employer did not establish and implement a written respiratory protection program where employees were wearing tight fitting, filtering face piece respirators while performing tasks, such as (but not limited to) spray painting, cutting and grinding.

29 CFR 1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.    WORKPLACE: The employees who were wearing tight fitting half face respirators did not have a medical evaluation conducted to ensure the employees were able to wear the respirators.

29 CFR 1910.134(f)(2):  The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.    WORKPLACE: The employees wearing tight fitting half face respirators during the course of work had not received fit testing for each type respirator they were using.

29 CFR 1910.134(g)(1)(i)(A): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function; or any condition that interferes with the face-to-facepiece seal or valve function.    WORKPLACE: The employees were allowed to wear tight fitting half face respirators with facial hair that interfered with the proper sealing of the respirator.

29 CFR 1910.134(h)(2)(i): All respirators shall be stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals, and they shall be packed or stored to prevent deformation of the facepiece and exhalation valve.    WORKPLACE: Two (2) Gerson model 8200 tight fitting half face respirators were found unprotected and lying on the mixing table and on the paint mixing rack.

29 CFR 1910.134(k)(1): The employer shall ensure that each employee can demonstrate knowledge of at least the following: Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator; What the limitations and capabilities of the respirator are;  How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; How to inspect, put on and remove, use, and check the seals of the respirator;What the procedures are for maintenance and storage of the respirator; How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators; and The general requirements of this section.      WORKPLACE: The employees required to wear tight fitting and filtering facepiece face respirators during the course of work were not provided with training.
