29 CFR 1926.600(a)(6): All equipment covered by this subpart shall comply with 29 CFR 1926.600(a)(6)(i) thru 1926.600(a)(6)(vii)(B) when working or being moved in the vicinity of power lines or energized transmitters, except where electrical distribution and transmission lines have been deenergized and visibly grounded at point of work or where insulating barriers, not a part of or an attachment to the equipment or machinery, have been erected to prevent physical contact with the lines:  (a) 309 Albritton Rd. Andalusia, AL 36420: On or about May 24, 2012 and at times prior to; the employer exposed his employees electrical shock hazards in that employees were allowed to work 3 feet within 50 KV power lines while operating an excavator.

Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) 309 Albritton Rd. Andalusia, AL 36420: On or about May 24, 2012 and at times prior to; the employer exposed his employees to an engulfing/crushing hazard in that he allowed employees to install 14 ft. 8 inch diameter sewer pipes in a  trench excavation which measured 8 feet in depth and 26 feet in length with spoil piles located at the trench excavation walls.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper that one and one half horizontal to one vertical (34 degrees measured from the horizontal):  (a) 309 Albritton Rd. Andalusia, AL 36420: On or about May 24, 2012 and at times prior to; the employer exposed his employees to crushing/engulfing hazards in that employees were allowed to install 14 ft. 8 inch sewer pipes in a 8 feet in depth and 26 feet in length trench excavation which had nearly vertical excavation walls that were not sloped back to the proper angle as required by the elements of Sloping/Benching options (2), (3), or (4).
