29 CFR 1910.1200(e)(1):   Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  On or about April 24, 2012, the employer did not develop, implement, and/or maintain a hazard communication program at the establishment for the employees exposed to chemicals, such as but not limited to Roccal-D Plus.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the  employer must submit documentation showing that it is in compliance with the standard,  including describing the steps that it is taking to ensure that the employer develops, implements, and/or maintains a hazard communication program when exposing employees.

29 CFR 1910.1200(f)(8):   The employer shall not remove or deface existing labels on incoming containers of hazardous chemicals, unless the container is immediately marked with the required information.  On or about, the employer did not ensure that each of the containers/spray bottles containing Roccal-D Plus were properly labeled, exposing the employees to the hazards of the chemical.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each container and/or bottle is properly labeled for employee safety.

29 CFR 1910.1200(g)(1):   Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use.  On or about April 24, 2012, the employer did not retain a copy of the material safety data sheets for the chemicals used by the employees, exposing the employees to the inhalation and absorbtion hazards of the chemicals used.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employer retain copies of the material safety data sheets.
