29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) On or about May 23, 2012, near the northeast corner of the residence, an employee who was assisting with the replacement of the roof was not using any type of fall protection. The employee was exposed to falls of approximately 8 feet to the ground below.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed. (a) On or about May 23, 2012, at the back of the residence, employees used a nine-foot aluminum ladder to access the roof. The ladder was designed to be used as a step ladder, but was leaning against the house and not opened into position. The employees were exposed to fall hazards of approximately 8 feet to the concrete below.
