29 CFR 1910.178(m)(5)(i): When powered industrial trucks were left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes were not set: a) On or about 5/22/12 at the Allied Health Building project located at Alfred State College, Alfred, New York; an employee operating an all terrain forklift got out of the machine and climbed in to a dumpster to pull a load off from the forks. The machine was left running and the load was still elevated. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening: a) On or about 5/22/12 at the Allied Health Building project located at Alfred State College, Alfred, New York; an employee working at the front of the building at a wall opening on the second floor. The employee was not protected from falling of approximately 12 feet. NO ABATEMENT CERTIFICATION REQUIRED
