29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Coffee Blending/Mixing Operation, 101 Campus Drive, Jersey City, NJ 07305 Employees loading the coffee blending machine with raw coffee beans were exposed to continuous noise levels that were equivalent to 70.42% of the hearing conservation action level dose of 50%. This exposure which is equivalent to an 8 hour time-weighted average of 87.25 dBA, exceeded the action level of 50% or 85 dBA. The sample time was 7 hours and 50 minutes. Zero exposure was assumed for the unsampled time period of 60 minutes (lunch break). The employer did not have an effective hearing conservation program. Violation occurred on or about 06/12/2012.
