29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:        (a)   The employer did not provide a training program for each employee exposed to fall hazards on how to recognize the hazards of falling and the procedures to be followed to minimize the hazards.  On May 25, 2012, two employees re-roofing a roof at 7345 Elbrook Road exposed to a 19' fall hazard were not trained to follow procedures to utilize personal fall system while tearing off the old roofing shingles.

29 CFR 1926.1053(b)(8):     Ladders placed in any location where they can be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, shall be secured to prevent accidental displacement, or a barricade shall be used to keep the activities or traffic away from the ladder.    (a)   On May 25, 2012, the ladder being used by the two employees for access and egress from the 10/12 pitch roof was not secured to prevent accidental displacement nor was it barricaded to prevent driveway traffic from exposing employees to a 19' fall hazard.

29 CFR 1926.1060(a)(1)(v):     The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the standards contained in Subpart X:    (a)  On May 25, 2012, employees performing re-roofing workexposed to a 19' fall were not trained on the use of ladders by a competent person to ensure that employees were securing the ladder or barricading the ladder located in the driveway at 7345 Elbrook Road, to prevent displacement of the ladder.

29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    (a)  On May 25, 2012, site inspections were not conducted by a competent person designated by the employer in that employees were engaged in reroofing activities on a residential structure located at 7345 Elbrook Road were not utilizing any type of fall protection nor were the employees securing the ladder being utilizing on site.  Employees were exposed to a 19' fall hazard.      Espinoza Construction was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA inspection number 315337675, citation number 1, item number 1, issued on February 28, 2011.

29 CFR 1926.501(b)(13):     Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):      (a) On May 25, 2012, employees performing residential construction activities such as tearing off old shingles on a 10/12 and 8/12 pitch roof located at 7345 Elbrook Road were not protected by guardrail systems or personal fall arrest system while exposed to a 19' fall hazard.    Espinoza Construction was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA inspection number 315337675, citation number 1, item number 2, issued on February 28, 2011.
