OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by passing vehicular traffic from a lack of methods and devices conspicuously placed to alert, channel, and protect against approaching vehicular traffic: A.) Signs Here, Inc. dba Fast Signs, 1128 West 12th Street, Erie, PA 16502, south side of structure, on or about May 25, 2012 and times prior thereto: Employees were performing work operations in and around a van equipped with a Versa lift articulating man lift (M/N VAN28B, S/N: 1182303). The van was located within 6-inches of the road shoulder near the west bound side of W 12th Street. There was no signage in place to warn motorists of work taking place near the side of the road shoulder. In addition, devices such as channelizing devices and truck mounted attenuators were not utilized as an alternative means of protection.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: A.) Signs Here, Inc. dba Fast Signs, 1128 West 12th Street, Erie, PA 16502, south side of structure, on or about May 25, 2012 and times prior thereto: Employees were installing a toaster cover sign on an existing roof top sign. The area where the employees were performing work did not have standard guard railing, which exposes employee to a fall hazard of 19 feet. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: A.) Signs Here, Inc. dba Fast Signs, 1128 West 12th Street, Erie, PA 16502, south side of structure, on or about May 25, 2012 and times prior thereto: Employees were installing a toaster cover sign on an existing roof top sign. Employees were not utilizing personal fall arrest systems, which exposes employee to a fall hazard of 19 feet.

Signs Here, Inc. dba Fast Signs, 1128 West 12th Street, Erie, PA 16502, south side of structure, on or about May 25, 2012 and times prior thereto: Van equipped with a Versa lift articulating man lift (M/N VAN28B, S/N: 1182303). Employees were not wearing fall protection when in the basket of the man lift and exposed to a fall hazard of at least 19-feet, as well as a potential catapult hazard. Personnel were working from the basket of the lift and utilizing the basket as a means of access to the roof of a building.
