29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Two workers were exposed to fall hazards as they replaced the bad wood and performed touch-up painting during the balcony banister replacement project at Baxter Crossings, 975 Westmeade Drive, Chesterfield, MO, 63005: a) One worker was exposed to an approximate 20.4 foot fall hazard while working from the roof to access the third floor balcony railings of the 16607-16629 apartment building. b) Two workers were exposed to an approximate 10.3 foot fall hazard while working from second floor balconies to replace bad wood and touch-up paint prior to the new banister installation.
