OSH ACT of 1970 Section (5)(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a motorized platform hoist.    a) Construction site, 84 Newman Ave., Bayonne, NJ    Employees used a motorized RGC Pro 200 Track material hoist to climb up to a roof where they were constructing a new roof with materials including asphalt shingles, approximately 29 feet from grade.  This hoist was not designed for climbing or use as a ladder.      Among other abatement methods, one feasible and acceptable method of abatement is to follow all manufacturer requirements for installation and use, including, but not limited to, never climb on the material hoist. 29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b)    Note: if using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of section 1926.502.    Worksite, 84 Newman Ave., Bayonne, NJ    Employees working on a 7:12 pitch roof approximately 29 feet from grade were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.
