29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area and chemical-specific information was not always available through labels and material safety data sheets.    On 4/25/2012, the employer was not providing employees information and training on hazardous chemicals in their work area at the time of their initial assignment, were employes were required to work witn concrete on a daily basis.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.    On or about 4/14/2012, the employer did not require employees exposed to concrete during bridge construction to wear adequate hand or foot protection. Extended exposure to concrete on 4/14 resulted in three employees receiving burns to their feet and ankles.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.452(w)(4): Power systems used to propel mobile scaffolds shall be designed for such use. Forklifts, trucks, similar motor vehicles or add-on motors shall not be used to propel scaffolds unless the scaffold is designed for such propulsion systems.     On or about 4/25/2012, the employer permitted use of dump trucks to be used as a base to support scaffold components while bridge work was conducted by employees.
