Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:    (a)  On or about May 25, 2012, for the employee using Hilti HIT-TZ threaded anchor rods to secure a 28-foot tall steel column and did not follow the manufacturer's instructions for installation resulting in the steel column tipping over, at the Sheyenne Addition, located at 800 40th Avenue East, West Fargo, North Dakota.    Abatement Note:  Among other methods, one feasible and acceptable method of abatement would be to obtain approval from the engineer of record for the project and follow the requirements identified in the manufacturer's installation instructions for the anchors being used.

29 CFR 1926.755(a)(4):  All columns were not evaluated by a competent person to determine whether guying or bracing was needed:    (a)  On or about May 25, 2012, for the employee and other contractor's employees in the area exposed to struck-by/crushing hazards while setting a 28-foot tall steel column using anchor rods that were not installed in accordance with the manufacturer's instructions at the Sheyenne Addition construction project, located at 800 40th Avenue East, West Fargo, North Dakota.

29 CFR 1926.755(b)(1):  Anchor rods (anchor bolts) were repaired, replaced or field-modified without the approval of the project structural engineer of record:    (a)  On or about May 25, 2012, for the employee and employees of other contractors exposed to crushing hazards while attempting to use a compression anchor and a threaded anchor when the approved shop drawing called for a screw anchor to secure a 28-foot tall steel column, at the Sheyenne Addition construction project, located at 800 40th Avenue East, West Fargo, North Dakota.
