OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a) Adipic Acid Handling Area: The granular Adipic Acid in the process was determined to be a Class II dust with a Kst of 12.33. The employees were exposed to the hazard of fire or explosion while working in the Adipic Acid Handling System area, but preventative maintenance such as, but not limited to, continuity testing to ensure the system is conductive had not been done, on or about May 21, 2012. b) Adipic Acid Handling Area: The employees were exposed to the hazard of fire or explosion while working in the Adipic Acid Handling System area, but preventative maintenance such as, but not limited to, periodic inspection of the system of lines, couplings and elbows used for pneumatic conveying to ensure they remained dusttight, was not conducted, or about May 21, 2012.
