29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. At the site: The employer failed to ensure that the ladder was at least 3 feet above the upper landing surface or tied off and secured. The employees were installing a 7.5 ton air conditioner on a residential building while using a 28 feet ladder. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step. At the site: An employee used the top step of an 8 feet A-Frame medal ladder to egress/ingress a caged metal ladder, leading to the upper landing surface of the roof, and they were tasked to install a 7.5 ton air conditioner at a newly renovated facility converted for medical use. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. Employees were using an 8 feet and a 28 feet ladder at the site to install a 7.5 ton air conditioner on a newly renovated building designated for a medical office. The employer did not provide a training and education program for employees who are require to use ladders and/or stairways where as they were instructed to recognize hazards relating to ladders/stairways and the procedure to take to minimize the hazard of falls. ABATEMENT DOCUMENTATION REQUIRED
