29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). On or about May 30, 2012, employees were working in and kneeling down inside an excavation that was measured at 5 feet in depth. The employer did not have the north side of the excavation benched, sloped or protected by shoring and the employees were exposed to the hazard of cave-ins.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement. On or about May 30, 2012 and at times prior thereto, employees working in an excavation were exposed to the hazards of impalement by metal rebar, when entering and exiting the concrete manhole box.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: On or about May 30, 2012, an employee working in an 5 foot deep excavation, entered into a wooden sewer box by means of a 2 foot sewer pipe and climbed down inside without the use of a ladder.
