29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement. Jobsite: Employees were exposed to #4 rebar that was 3ft in height, while working in the southeast corner of the project while installing wall forms exposing employees to potential impalement hazards.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. Jobsite: Employees were exposed to broken plexi-glass that was installed over the winter months on a Caterpillar Lull machine on the right side of the machine. Along with a homemade wooden door that was modified to fit the cab of the Lull.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. Jobsite: Employees workikng in an open excavation did not have a properly placed ladder that extended 3 feet above the upper level for easy access in and out nor was the angle of the ladder properly place to the 4 to 1 ratio.
