29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about May 21, 2012 and times prior thereto, at the well site located at or near Dumas #1 and other locations, El Dorado, AR, employees who were assigned duties involving the maintenance, repair or demolition of tanks were not effectively trained in the recognition and avoidance of unsafe conditions. In one instance, three employees performing work at the aforementioned location were fatally injured when a tank containing flammable residue exploded. The failure to adequately and effectively train employees in the hazards associated with storage tank repair, maintenance and demolition exposed employees to fire hazards such as, but not limited to, smoke inhalation and thermal injuries from explosions and/or tank collapse.

29 CFR 1926.850(e): It shall be determined if any type of hazardous chemicals, gases, explosives, flammable materials, or similarly dangerous substances have been used in any pipes, tanks, or other equipment on the property. When the presence of any such substances is apparent or suspected, testing and purging shall be performed and the hazard eliminated before demolition is started. On or about May 21, 2012 and times prior thereto at the well site located at or near Dumas #1, El Dorado, AR, employees were dismantling a tank from the tank battery. Testing and purging was not conducted to eliminate the hazards associated with flammable liquids and vapors prior to conducting work. Employees were exposed to hazards such as, but not limited to, a flash fire, smoke inhalation and thermal injuries.
