OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards, electrical hazards and crush hazards.      a.   Icing Department - On or about May 30, 2012, the pendant control boxes on the overhead hoist on line #2 and line #3 were not labeled, thereby exposing employees to crush type injuries.    b.  Icing Department - On or about May 30, 2012, the pendant control box on the overhead hoist on line #2 were not constructed to prevent accidental contact with electrical components, thereby exposing employees to electrical type injuries    c.  Icing Department - On or about May 30, 2012, the employer had not performed a frequent inspection on the overhead hoist, serial #LW242LB on line #2, and overhead hoist, serial # LW0315NR on line #3, thereby exposing employees to struck by hazards.    d.  Icing Department - On or about May 30, 2012, the employer had not performed a periodic inspection on the overhead hoist, serial #LW242LB on line #2, and overhead hoist, serial # LW0315NR on line #3, thereby exposing employees to struck by hazards.    e. Icing Department - On or about May 30, 2012, the employer had not performed inspections on the hooks on each of the overhead hoists on line #2 and line #3, thereby exposing employees to struck by hazards.

29 CFR 1910.184(d):     Inspections. Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service.    a.  Icing Department - On or about May 30, 2012, the employer had not performed inspections on slings and attachments, thereby exposing employees to struck by hazards.

29 CFR 1910.184(i)(1):     Sling identification. Each sling shall be marked or coded to show the rated capacities for each type of hitch and type of synthetic web material.    a.  Icing Department - On or about May 30, 2012, the sling used to move the icing rollers located on line #2 and line #3 did not identify the rated weight capacities it was capable of handling, thereby exposing employees to struck by hazards.
