29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Palmer Waterproofing - Stewart Middle School: An employee, Masonry Worker, cutting mortar, removing bricks and installing flashing around a second story window was observed wearing a half-mask elastomeric respirator without having a medical evaluation to ensure the employees ability to wear a respirator, on or about 5/31/2012. b) Palmer Waterproofing - Stewart Middle School: An employee, Brick Layer, operating an electric chipper from an aerial lift was observed wearing a half-mask elastomeric respirator without having a medical evaluation to ensure the employees ability to wear a respirator, on or about 5/31/2012. c) Palmer Waterproofing - Stewart Middle School: An employee, Brick Layer, removing bricks from an aerial lift was observed wearing a half-mask elastomeric respirator without having a medical evaluation to ensure the employees ability to wear a respirator, on or about 5/31/2012. No abatement certification or documentation required.
