29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, Exterior - An employee was exposed to a fall of approximately 12ft to the ground below while walking and working on the edge of an overhang on a two story residential home; on or about 5/31/12.      Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(b)(1):   Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)      a)  Worksite, Exterior - Employees were working on the first and second tier of a fabricated frame scaffold ranging in height from 6 - 12ft above the ground.  The scaffold was missing planking on each tier; on or about 5/31/12.      N & M Stucco was previously cited for a violation of this Occupational Safety and Health Standard, Its equivalent, or essentially similar standard 29 CFR 1926.451(b)(1) which was contained in OSHA inspection number 313425829 citation number 01, item number 2a, issued on 03/22/2010 and became final order on 05/06/2010.        Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:      a)  Worksite, exterior of home - Employees were applying stucco to a two story residential home while working on the second tier of a fabricated frame scaffold.  The employees were not protected from falling approximately 12ft to the ground below; on or about 5/31/12.    b)  Worksite, front of home - An employee was installing styro foam to the exterior of a residential home.  The employee was working on a single 2x12 in plank and was not protected from falling approximately 12ft to the ground below; on or about 5/31/12.    N & M Stucco was previously cited for a violation of this Occupational Safety and Health Standard, Its equivalent, or essentially similar standard 29 CFR 1926.451(g)(1) which was contained in OSHA inspection number 313425829 citation number 01, item number 3b, issued on 03/22/2010 and became final order on 05/06/2010.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
