OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were improperly using fall protection equipment/components.    On or about 5/16/2012, at the McDonough distribution center, employees were using fall protection components improperly in that employees anchored the 5' Preferred Safety Porducts, Inc. lanyard by wrapping it around the guardrails of a manbasket and back into itself rather than attaching the lanyard to an appropriate anchorage point per the manufacturer's specifications.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly.    On or about 5/16/2012, at the McDonough distribution center, employees were exposed to fall hazards as they used job made man baskets/lifts/carts that had not been "approved" by the powered industrial lift manufacturer as an attachment.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area and chemical-specific information was not always available through labels and material safety data sheets.    On or about 5/16/2012, at the McDonough distribution facility, the employer did not provide Hazard Communication training to all employees in that employees that were considered "contracted" or "temporary" employees did not receive training on the employer's Hazard Communication program.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about 5/16/12, in the McDonough warehouse area, the employer did not identify where extinguishers were located in that signs and directional arrows did not correctly indicate the actual location of fire extinguishers.
