29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On or about May 31, 2012, at the above addressed jobsite, employees were installing a sewer line in an excavation measured at five (5) feet eleven (11) inches in depth. The excavation was not provided with cave in protection, thereby exposing the employees to cave in hazards. THE J&S CONSTRUCTION SEWER & WATER, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315154575, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 6, 2011 WITH RESPECT TO A WORKPLACE LOCATED AT CORNER OF 104TH PLACE AND TODD DRIVE, PALOS HILLS, ILLINOIS, 60465.
