OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm:     In that, employees were exposed to the hazard of falling from heights when elevated by the Catepillar V50C fork lift in a shop fabricated personnel basket to perform tasks, such as repairing overhead lights, inspecting overhead hoists, etc.       On or around 5/31/2012, the employer did not ensure that the employee was working from a personnel platform which was secured to the mast.  The platform was elevated to 18 to 20 feet when the forklift rolled down and off a truck bed and struck a shear press, causing the platform to partially slide off the forks.                                                                           Abatement Certification and Documentation is required.

29 CFR 1910.178(m)(5)(i):     When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.      a.)  On 5/31/2012, a Catepillar V50C fork lift used to lift a man basket 20 feet high while parked on the bed of a Mack truck was left unattended with the load still extended and the power shut off.  The emergency brake was not set nor wheels blocked as the operator left the fork lift to access gloves per the maintenance supervisor's request.   The operator was dismounted from the flat bed and was on the floor surface with his back to the fork lift in order to get to the gloves.                                             Abatement Certification and Documentation is required.
