OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm:     In that, employees were exposed to the hazard of falling from heights when elevated by the Catepillar V50C fork lift in a shop fabricated personnel basket to perform tasks, such as repairing overhead lights, inspecting overhead hoists, etc.       On or around 5/31/2012, the employer did not ensure that the employee was working from a personnel platform which was secured to the mast.  The platform was elevated to 18 to 20 feet when the forklift rolled down and off a truck bed and struck a shear press, causing the platform to partially slide off the forks.                                                                           Abatement Certification and Documentation is required.

The employer used a shop-fabricated man basket over the forks of Catepillar V50C powered industrial truck to lift an employee 20 feet high to change light fixtures. 29 CFR 1910.178(l):     Operators were not trained in the safe operation of powered industrial trucks:      a.)  On or before 5/31/2012, the company had not evaluated nor confirmed training necessary to operate powered industrial trucks had been completed for each employee using company trucks.  The training provided to employees by previous employers was not specific to the current company fork lift usage.  No additional training was conducted by the company.  Equipment used in the company included:    *    Catepillar V50C, 5000# capacity fork lift,  SN 39Y02284  *    Catepillar GPL40 or GPL45, SN 1CN90316, 9000 # capacity fork lift,  *    Hyster S40C, 4000# capacity fork lift, SN C2D17648V, and  *    Company manufactured man-basket, and other equipment used with the fork lifts.                                               Abatement Certification and Documentation is required.

29 CFR 1910.178(m)(5)(i):     When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.      a.)  On 5/31/2012, a Catepillar V50C fork lift used to lift a man basket 20 feet high while parked on the bed of a Mack truck was left unattended with the load still extended and the power shut off.  The emergency brake was not set nor wheels blocked as the operator left the fork lift to access gloves per the maintenance supervisor's request.   The operator was dismounted from the flat bed and was on the floor surface with his back to the fork lift in order to get to the gloves.                                             Abatement Certification and Documentation is required.

29 CFR 1910.178(m)(6):     A safe distance was not maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car    a.)  On 5/31/2012, a Catepillar forklift was operated on top of and on the end of a Mack truck bed.  The section of the truck bed past the axles was deformed from the loading weight of the equipment, causing the forklift to move forward and over the edge of the truck bed. 29 CFR 1910.178(q)(7):     Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle      a.)  On or before 5/31/2012, there was no requirement to examine fork lift trucks prior to used for the shift.  Employees using company fork lifts knew of multiple mechanical problems, including bad brakes, and the fork lifts  were never removed from service nor repaired until after an accident occurred.                                    Abatement Certification and Documentation is required.
