P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: as a result employees were exposed to crushing, struck by, ejection and tip-over hazards: At the job site, located on highway 17 South, the liquid Boom Angle indicator was broken on a LULL, Model 6-K, Highlander Rough Terrain Forklift, S/N 98X13N21475, as a result employees were exposed to hazards such as but not limited to crushing, struck by, ejection and tip-over hazards. The purpose of the Boom Angle Indicator shows the angle of the boom relative to level ground. Per the manufactures operating instructions the use of the Boom Angle Extension Indicator must be used in conjunction with the machine Load Chart to determine correct boom lifting capacities. The load charts for each forklift, S/N 98X13N21475 and S/N APR96X12N17229, was not made available at the jobsite. a)Outside, on the west side of the building, on or about November 27, 2009, the employer was operating a LULL, Model 6-K, Highlander rough terrain forklift, S/N 98X13N21475, elevating workers in an approved work platform with a defective Boom Angle Indicator, exposing employees to crushing, struck by, ejection and tip-over hazards. b)Outside, on the west side of the building, on or about November 27, 2009, the employer did not ensure load charts were made available for two LULL, Model 6-K, Highlander rough terrain forklifts, S/N 98X13N21475 and S/N APR96X12N17229, which were being used to elevated workers in an approved work platform, exposing employees to crushing, struck by, ejection and tip-over hazards. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: 1.Ensure employer consult with the ANSI/ITSDF B56.6-2005, which states that a method of indicating boom angle in degrees shall be provided using 0 degrees at the horizontal position of the boom and shall be visible to the operator in his operating position. 2.Ensure employer consult with LULL operator's safety manual and the specific load chart designated for the specific piece of equipment and attachments to determine proper load capacity. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.
