OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of impalement from protruding rebar in the ground. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the obligation, including describing the steps that it is taking to ensure protruding rebar is removed, bent, or capped to prevent an impalement hazard.

29 CFR 1926.405(b)(2): Covers and canopies. All pull boxes, junction boxes, and fittings shall be provided with covers. If metal covers are used, they shall be grounded. In energized installations each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear. On or about 31 May 2012, and at times prior thereto, the employer did not ensure a cover was installed on a breaker panel located within the general contractor's office, exposing workers to electrical shock or electrocution by live components at approximately 220 volts. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure all electrical panels are covered in order to protect workers from live components.

29 CFR 1926.417(b): Equipment and circuits. Equipment or circuits that are deenergized shall be rendered inoperative and shall have tags attached at all points where such equipment or circuits can be energized. On or about 31 May 2012, and at times prior thereto, the employer did not lockout or tagout the electrical source for a de-energized breaker panel that had the cover removed to "air out" the components which were located within the general contractor's office, exposing workers to electrical shock or electrocution by live components at approximately 220 volts. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure all de-energized electrical panels are locked out and/or tagged out during repair or maintenence to such in order to protect workers from live components.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed. On or about 31 May 2012, and at times prior thereto, a worker was utilizing a folding 8 foot fiberglass ladder in a manner that it was not designed for. The worker had it folded and leaning against the wall while he was standing on the 5th rung up from the ground, knocking out the window frame as part of demolition activities. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure ladders on the job site are used for the purpose for which they were designed.
