An Employee working from a four in twelve pitch roof was exposed to falls of approximately 9 feet to a lower level. The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. Employees installing shingles with a pneumatic nail gun were not wearing ANSI rate Z87.1 eye protection. The employer failed to provide his employees with eye protection while using a pneumatic nail gun.

Employee were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.
