29 CFR 1926.501(b)(13):     Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):    a)  At 273 West South Blvd Montgomery, Al:  On or about May 30, 2012 and at times prior; the employer exposed his employees to fall hazards in that employees were allowed to work on a roof that was 9.3 feet above the ground with a 5:12 slope without being protected from falling by a guardrail system with toe boards, safety net system, or personal fall arrest system.

29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 273 West South Blvd Montgomery, Al:  On or about May 30, 2012 and at times prior; the employer failed to ensure ladders being used by employees to gain access to the roof extended three feet above the landing area exposing the employees to falls of 9.3 feet to the ground below.
