29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):     a) For the Killebrew work site on old Hwy 37, Lakeland, FL, as observed on or about 05/30/2012, employees were working in an excavation that was measured to be 5 ft. 1/4 inches deep at the location employees were working. No cave in protection was being used and the excavation side walls were measured to be 72.3 degrees on the west side and 81.3 degrees on the east side of the excavation. The soil was analyzed to be type C and employees working in the excavation were exposed to cave-in hazards.    Killebrew, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 315671032, citation number 1, item number 1 and was affirmed as a final order on 06/06/2011, with respect to a workplace located at Hwy 27, Davenport, FL.
