OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health act of 1970: The employer did not furnish to each of his employees, employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an extension ladder that did not have its side rails positioned at least 3-feet above the upper landing surface:     a) Erie Sign Corporation / 2827 West 26th Street, Erie, PA: On or about June 4, 2012 a portable metal ladder was used to access a flat roof. The top of the ladder extended approximately 1-1/2 feet from the landing area of the roof.   The condition exposed personnel utilizing the ladder to a potential fall hazard.

29 CFR 1910.23(c)(1):     Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    a) Erie Sign Corporation / 2827 West 26th Street, Erie, PA: On or about June 4, 2012 an employee was on a roof that was approximately 12-1/2 feet from ground to eave height without the use of railings. The employee was on the roof to remove signs that were stored there while the building was being remodeled.    IN THE ALTERNATIVE:  29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a) Erie Sign Corporation / 2827 West 26th Street, Erie, PA: On or about June 4, 2012 an employee was on a roof that was approximately 12-1/2 feet from ground to eave height without the use of a personal fall arrest system. The employee was on the roof to remove signs that were stored there while the building was being remodeled.
