29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. At the job site, on June 1, 2012, an employee was operating a Sky Trac fork lift Model 10054 and was not wearing athe proper personnel protective equipment (seat belt), exposing him to ejection from the forklift in an accident.
