29 CFR 1910.120(q)(6)(iii): Employees who participated as hazardous materials technicians, or were expected to participate as hazardous materials technicians, had not received at least 24 hours of training equal to the first responder operations level, and in addition have competency in the areas outlined in 29 CFR 1910.120(q)(6)(iii)(A) through (q)(6)(iii)(I) and/or the employer did not so certify: (a) Location - Waste Treatment Area: On or about 8/8/12, an employee participated in the response to a release as a hazardous materials technician and had not received at least 24 hours of training meeting the requirements of 1910.120(q)(6)(iii).

29 CFR 1910.120(q)(6)(v): Incident commanders did not receive at least 24 hours of training equal to the first responder operations level and in addition have competency in the areas outline in 29 CFR 1910.120(q)(6)(v)(A) through (q)(6)(v)(F) and/or the employer did not so certify: (a) Location - Facility: On or about 5/14/12, an employee listed in the company's intergrated contingency plan as having the responsibilities of incident commander had not been trained in the areas required by 1910.120(q)(6)(v). Specific areas where training was lacking includes but is not limited to knowledege of how to implement the local emergency response plan and knowledge of the state emergency response plan and of the Federal Regional Response Team.
