29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.    On or about May 10, 2012, employees were exposed to fall hazards when employees using ladders had not been trained to recognize hazards such as, but not limited to, using an A-frame ladder leaning against a wall to climb out of an excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.    On or about May 10, 2012, employees were exposed to struck-by hazards when daily inspections were not made by a person who was competent and able to recognize hazards such as, but not limited to, straight-sided excavations deeper than five feet in type B soil with no cave-in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) or 29 CFR 1926.652(b)(1)(i).    On or about May 10, 2012, employees were exposed to struck-by hazards when employees were working in an excavation approximately eight feet deep with straight side walls with no cave-in protection.  Employees were working 2-3 feet from the walls installing concrete frames, rebar, and pouring concrete for the steps.
