29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:    Two workers used the crossbraces of the tubular welded frame scaffold for access to the scaffold working platform.

29 CFR 1926.451(f)(7):     Scaffolds were not erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:    At the job site, the tubular welded frame scaffold was used to access the north exterior side of the two story residential structure during the application of stucco base coat.  The employees used an approximate 13.2 foot high scaffold platform that had no guardrail system to protect employees from falling.  The work platform of this scaffold was not fully planked from which the employees who walked or worked on the platform could have fallen.  The crossbraces were used to access the work platform.  Additionally, the base plates of the scaffold system were not placed on mud sills.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    No fall protection system was in use as an employee was working from the roof to apply the stucco base coat to the upper portion of the residential structure located at 468 Maple Rise Path, Chesterfield, MO, 63005.  The eave to ground height was approximately 11.1 feet at the north side of the structure.
