29 CFR 1910.132(a):     Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  		    At the worksite and on June 5, 2012, where a powered industrial truck, Datsun-Model CPF02A2OV-Serial #CPF02-003547, was being operated without wearing the supplied seatbelt, hereby exposing the employee to stuck by hazards.

29 CFR 1910.23(c)(3):     Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board.    At the worksite and along the temper line, a platform adjacent to dangerous equipment, had an unguarded side, thereby exposing employees to falls and burns.
