29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees: At the site, a trench ,with two employees connecting portions of an existing waterline to a new section, had a tree with an approximate height of 10' and a LASKO 4900 series airmover tied to the tree located such that it presented a struck-by and cave-in hazards.

29 CFR 1926.651(j): The employer did not ensure that employees were protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into the excavation by a minimum distance of at least 2 feet (.61m) from the edge of the excavation.
