29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    a) 1036 N. Leithgow St.- Employees were exposed to a fall hazard of up to approximately 16 feet while working from the tubular welded frame scaffold which did not have the required guardrails along the ends and back of the active work platforms.  Employees were doing masonry work including the installation of new brick to the exterior of the new house.  Observed 6/5/2012.    NOTE: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    a) 1036 N. Leithgow St., Genie Aerial Lift - An employee was exposed to a fall hazard of approximately 17 feet while working from the elevated aerial lift and not using the required personal fall arrest system.  Onserved 6/5/2012    NOTE: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Leithgow St. - The masons tender (laborer) was standing on a single 2 by 10 scaffold plank while at an elevation of approximately 12 feet above the sidewalk.  Observed 6/5/2012.    NOTE: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6).    a) 1036 N. Leithgow St., Tubular Welded Frame Scaffold & Power Line - Portions of both the main 240 VAC power line and the service line that fed the structure were not appropriately protected.  Sections of the insulated power lines that ran within two feet of the scaffold and through the scaffold did not have protective coverings installed.      NOTE: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
