29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented: a) Ostorga Construction at 3278 Denargo St., Denver, CO 80216: On or about 6/2/12, the employer did not ensure that an employee was protected from falling when sheathing the top floor in that no personal fall arrest system, no guardrail system, and no fall monitoring system was in place. Condition exposed this employee to fall hazards of approximately 40 feet.
