29 CFR 1926.602(c)(1)(ii):     Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval:    On June 6, 2012, at 2506 Sens Rd., La Porte, TX, employees were exposed to struck by hazards when using a Traverse Lift powered industrial truck, Model TL 6035, Serial number 60762-ccc, to lift a beam weighing 2,394 pounds using the method of "free rigging/under slinging."

29 CFR 1926.761(b):     The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:    On June 9, 2012, at 2506 Sens Rd., La Porte, TX, employees are exposed to fall hazards at a height of greater than 25 feet during the connection phase of the red iron horizontal beams and purlin.  Training records were requested on June 9, 2012 and none were received as of September 20, 2012.
