OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about June 4, 2012, at terminal dock 17, where employees were exposed to a struck-by hazard when standing near flatbed trucks while being loaded with 16 inch by 40 foot pipe, weighing 2800 pounds, without any protection from being struck-by uncontained pipe. Among other feasible methods to correct the identified hazard, one method would be to have truck drivers and pushers assemble in a designated safe location away from loading and unloading cargo operations that can endanger employees.
