29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. On or about June 6, 2012 and times prior thereto, employees of Mario Salazar were re-roofing a steep sloped roof with a pitch of 12:12 on a two story residence located at 1708 S. 43rd St. in Rogers, Arkansas. The employees were observed walking and performing work on the rooftop without the use of adequate fall protection, exposing employees to a falling distance of greater than six (6) feet.
