29 CFR 1926.502(b)(4): When the 200 pound (890 N) test load specified in paragraph (b)(3) of this section is applied in a downward direction, the top edge of the guardrail shall not deflect to a height less than 39 inches (1.0 m) above the walking/working level. Guardrail system components selected and constructed in accordance with the Appendix B to subpart M of this part will be deemed to meet this requirement. Waterford High School Project: Employees working on the third level were exposed to fall hazards. The wire rope guardrails system in use as fall protection deflected below 39 inches when any force was applied to it.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement. Waterford High School Project: Employees and subcontractors were exposed to impalement hazards while walking by and working near rebar that was protected using protective caps that were not designed for impalement protection.
