29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Jose Construction at 8171 E. 33rd Ave., Denver, CO 80238: On or about 6/2/12, the employer did not ensure that employees were protected from falling in the following instances: 1) Two employees were sheathing a 9 in 12 pitch roof without tying off. Condition exposed employees to fall hazards of 24'; 2) Employees were framing the upper floor that included a wall opening of 32" that was not guarded, and the employees were not wearing fall protection. Condition exposed employees to fall hazards of 10'3"; and 3) Employees were framing the upper floor that included an open landing above the stairwell that was 5'2" long on both sides. Condition exposed employees to fall hazards of 5'2".

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: a) Jose Construction at 8171 E. 33rd Ave., Denver, CO 80238: On or about 6/2/12, the employer allowed employees to use two stairways with 8 risers each without the use of at least one handrail and one stairrail system along the unprotected side or edge. Conditions exposed employees to fall hazards of up to 5'2".
